DATES: The “#MOTOACTVrun” Sweepstakes begins on May 4, 2012 at 9:00 a.m. EST and ends on May 6, 2012 at 11:59 p.m. EST (“Sweepstakes Period”).
WHO MAY ENTER: Open to all Canadian residents, age 18 and over. Individuals employed by Motorola Mobility Canada Ltd. (“Sponsor”), their affiliate companies, subsidiaries, advertising and promotion agencies, or judges (collectively “Sweepstakes Parties”) at any time during the Sweepstakes Period, and members of their immediate family or persons living in the same household, are not eligible.
HOW TO ENTER: To enter for a chance to win log on to www.twitter.com, a website owned and controlled by Twitter, Inc. You must tweet your favourite running song to @motorola_ca and include the hashtag #MOTOACTVrun.” Internet entries must be received by 11:59 PM EST on May 6, 2012. For purposes of these Official Rules, “receipt” of an entry occurs when Twitter’s servers record the entry information resulting from entrant clicking the “send” button on Twitter with a tweet containing “#MOTOACTVrun”. Any automated computer receipt (such as one confirming delivery of email) does not constitute proof of actual receipt by Sponsor for purposes of these Official Rules. Internet entries will be deemed made by the authorized account holder of the Twitter account at the time the entry is submitted. The authorized account holder is the natural person who is assigned to the email Twitter account by an Internet Service Provider or other organization that is responsible for assigning Twitter accounts or the domain names associated with Twitter. The potential winner may be required to provide Sweepstakes Parties with proof that he/she is the authorized account holder of the Twitter account associated with the winning entry. Limit one entry per person/Twitter account. Although subsequent attempts to enter may be received, only the first entry received from a particular individual Twitter account will be eligible; subsequent attempts to enter will be disqualified. The submission of an entry is solely the responsibility of the entrant. Entries may only be made according to the method described above. Automated entries (including but not limited to entries submitted using any robot, script, macro, or other automated service), are not permitted and will be disqualified.
HOW TO WIN: On or about May 7, 2012, a random drawing will be conducted by an agent of Motorola to select the winner from all eligible entries received. On or about May 8, 2012, the winner will be contacted via Twitter @reply or Direct Message. Once @Motorola_CA sends you an @reply or Direct Message, you will have 48 hours to direct message us your email address. Once we receive your email address, we will ask you for your mailing address and phone number so we can arrange for shipment of the MOTOACTV. It is the responsibility of entrant to maintain the Twitter account and email address used to enter Sweepstakes in good working order. All winners must meet the eligibility requirements set forth in these rules, and sign a declaration form, where permitted by law, in order to qualify for the prize. Potential winners will be required to correctly answer a time-limited mathematical skill-resting without assistance of any kind, whether mechanical or otherwise, before being declared a winner. Such question will be administered at a mutually convenient time either by phone, email or mail. If such entrant cannot be contacted and the skill-test administered within 5 business days of notification, the prize will be forfeited and awarded to an alternate entrant. No substitution, cash redemption or transfer of prize will be permitted except at Sponsor’s sole discretion. Sponsor reserves right to substitute prize with a prize of equal or greater monetary value if prize or a portion thereof becomes unavailable for any reason. No correspondence will be entered into except with selected entrants. The MOTOACTV will be shipped to the winner within four to six weeks of the initial email exchange. Any unclaimed prizes will be awarded in a random drawing to be held as necessary. Upon delivery to the winner’s address, Sponsor will be deemed to have awarded the prize to the winner with winner assuming full responsibility for the prize. Limit one prize per person. Note: You are not a winner of any prize until you have been verified as a winner by the judging Agency. Decisions of the judges are final in all matters relating to this Sweepstakes.
ODDS OF WINNING: The odds of winning depend upon the number of eligible entries received.
PRIZE: One (1) MOTOACTV plus soft armband, bike mount and wrist strap accessories (ARV $339.99). Winner will receive prize within four to six weeks of winner verification. Upon delivery to the winner’s address, Sponsor will be deemed to have awarded the prize to the winner with winner assuming full responsibility for the prize. All prize details are at Sponsor’s sole discretion. Only the prize specified in the number indicated will be awarded. Prize is non-transferable, with no cash redemption or equivalent. Sponsor reserves the right to substitute a prize or prize component of equal or greater value should a prize or any component of a prize become unavailable. Except as specifically provided herein, Prize package does not include insurance, personal expenses, incidental charges, gratuities, or any other items not specifically described in these Official Rules. Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of prize awarded. Sponsor makes no representation or warranties concerning the appearance, safety or performance of any prize awarded. Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor, except for the standard manufacturer’s warranty which comes with the MOTOACTV.
CLAIMING PRIZE: Unclaimed prizes will not be awarded. As a condition of winning the prize, winners must complete, sign and return a declaration form, where permitted by law, and any other applicable forms required by a taxing authority, within five (5) days of receipt of written prize notification or prize will be forfeited. If any correspondence of the independent judging agency or any prize is returned as undeliverable, the corresponding prize will be forfeited. Should a winner make any false statement(s) in any document referenced above, the winner will be required to promptly return to Sponsor his/her prize. Any unclaimed prizes will be awarded in a random drawing to be held as necessary. By accepting prize, entrants consent to Sponsor’s use of their name, photograph and/or likeness, address, voice, and statements made by or attributed to them, in perpetuity, in any and all media now known or hereafter developed (including, without limitation, print, broadcast and Internet), for all legitimate business purposes including advertising and promotional activities without additional compensation, unless prohibited by law. Upon delivery to the winner’s address, Sponsor will be deemed to have awarded the prize to the winner with winner assuming full responsibility for the prize.
MISCELLANEOUS CONDITIONS: All entries become the property of Sponsor and will not be returned. By participating entrants agree to abide by and be bound by these Official Rules and the decisions of the judges, which shall be final and binding with respect to all issues relating to this Sweepstakes. It is your responsibility to ensure that you have complied with all of the conditions contained in the Official Rules. Sponsor is not responsible for any lost, late, misdirected, stolen, illegible, incomplete entries, or for any computer, online, telephone or technical malfunctions that may occur. Sweepstakes Parties are not responsible for any incorrect or inaccurate information, whether caused by website users, any of the equipment or programming associated with or utilized in the Sweepstakes, or any technical or human error which may occur in the processing of submissions in the Sweepstakes. Sweepstakes Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The individual Sweepstakes Parties are solely responsible for their use of this information.
Arbitration and Choice of Law:This Sweepstakes is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Sweepstakes are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants. By entering this Sweepstakes, each entrant agrees to be bound by these Rules and all decisions of the Sponsor. Under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than Entrant’s actual out-of-pocket expenses (i.e., costs associated with entering this Sweepstakes), and Entrant further waives all rights to have damages multiplied or increased.
The Sponsor reserves the right to withdraw or amend this Sweepstakes (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Sweepstakes as contemplated by these Rules. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

LANGUAGE DISCREPANCY: In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Sweepstakes-related materials, including, but not limited to: the Sweepstakes entry form and/or point of sale, television, print or online advertising; the terms and conditions of these English Rules shall prevail, govern and control.
